On May 31, 1996, a driver for the defendant was driving a moving van from Lufkin, Texas, to Port Arthur, Texas. In 2006, we represented the family of a 22-year-old garbage collector who tragically lost his life due to workplace-related heat exhaustion. On just his second day on the job, he was assigned to haul trash along one of the city’s most demanding routes in extreme conditions. Despite rising temperatures and hazardous conditions, insufficient precautions and lack of proper safety measures contributed to our client’s fatal heat-related illness on the job.

The defendant, who was 17-years-old at the time, punched our client in the face, slammed him onto the concrete, and struck him with several hard elbows. After the assault, The defendant called our client’s friend, who was still inside the party, and told him, “Come get your boy out of the street,” leaving our client lying there.
Our client was rushed to the hospital and admitted to the ICU, where he was placed on a ventilator. He suffered multiple skull fractures and a broken clavicle as a result of the attack. Our client underwent extensive medical treatment and months of physical therapy to begin recovering from his life-threatening injuries.
